Dude is selling a few stripped/not stripped barreled receivers and parts from said receivers. But with this 1... He took it apart and took it to the ole band saw. The barrell is still pinned to the front chunk of the receiver. Are laws being skirted here or broke even? Different buyers for both. Its definitely not torch cut but being sold separately...?

Just trying to wrap my mind around doing this v/s just out right selling. He may have gotten a few bucks more like this but at about $333 plus shipping.... eh

I recognize those Hialeah FL store pics, I've looked at some of those mansil auctions before.

AH I'd be more than hesitant about purchasing any saw or wheel cut receivers or portions thereof. ATF generally specifies plasma torch and very specific types of cuts, although that's usually the NFA automatics that they get real persnickety about  fineprint

It's a very iffy subject, and a grey area, I am not an expert, nor a lawyer, not even a non attorney spokesperson, but, technically, it's not angle flame cut in 3 places, nor is a 1/4 to 3/8 inch section removed. These could be deemed deactivated, and as I understand, it is still technically still a firearm, it can chamber and fire and still requires a FFL, but not trueblue demilled, which requires the receiver to essentially be destroyed and in no way it can fire, which anyone can purchase. The receiver, is what the ATF considers the firearm, and even though it is cut in two, it's not technically destroyed per their policy/procedures and guidelines.
Everything I find says, taking in to account it's a SKS, not a FA, says:

Then it begs the issue, restoring it to it's former self, a whole other can of worms.

So, is it better to err on the side of safe and legal or spend some time at Club Fed.... Now, if playing the safe and legal route, then these chop jobs may not be legal, or still at least require a FFL at the very least. Or, maybe they fall in to the same category as a cut-away trainer, yes, they will still fire, very unsafe too do so, but typically, they will chamber and fire, again, deactivated vs. demilled.
And like any Govt. policy or procedure, if you couldn't get a written answer from the BATF, next step would be, move a step down and consult your state/local LEOs, then the buyer would have to consult their state/local LEOs, getting both responses in writing of course. A little CYA trumps I didn't know, you didn't know cause you didn't ask.


Maybe RM has some enlightenment to share...

Thanks man. That's what I was thinking on the torch cut in 3 places. Seems to me that the "parts kit" 1 even with the bit of receiver would probable be ok? but even though its only 3/4 of a receiver, that 1 would still require a FFL. A member here has a hunk of receiver with the bolt carrier welded ( IIRC?) to use for stripper clip loading purposes and he say's he still had to log it as a fire arm, again IIRC.

I think if you had the hunk of receiver an FFL would still be needed and if you had both w/o 1 ....You'd need to get out the ole waders cuz if the ATF or LEO wanted to ...you'd be in it deep.

Still makes me wonder why? His other barreled receivers would require an FFL, so why go through the trouble? Unless its FUBARed in some way I dont see.

Oh, how deep can it go.....let's just see,

It depends on which side is deemed the firearm, but, wait, one side can chamber and fire, the other side has the serial number.

So, in a way, in theory, you have a deactivated firearm with no serial, and a deactivated firearm receiver floating around, going to possibly two non FFL holders. :o

It could be a nasty, nasty place for all that are involved if they caught wind of it, possibly even the auction site could catch heat.  And it would put another feather in the anti's hat.
